Federal Agencies Provide Guidance for "Long COVID" under ADA

The Department of Health and Human Services (HHS) Office for Civil Rights and the Department of Justice (DOJ) Civil Rights Division have classified Post-Acute COVID-19 Syndrome, or “Long COVID,” as a disability, allowing for protections for people with continuing COVID-19 symptoms under the Americans with Disabilities Act (ADA). The two agencies have developed guidance to explain how “long-haulers” may be protected from discrimination under the ADA, the Rehabilitation Act of 1973, and the Affordable Care Act.
