ACP Action Alert: Urge Congress to End Harmful Step Therapy Protocols While Addressing the Issues of Cost and Transparency of Drugs!

Over the past year, ACP has been advocating with Congress for changes in law that would put an end to egregious practices that harm patients’ access to care and lifesaving treatments, namely onerous step therapy protocols and practices that result in the imposition of excessive costs and inadequate transparency.  We are asking AIMn members to engage with us on this advocacy effort as there are bipartisan legislative proposals pending that would address these important issues.

Step Therapy: There are bipartisan efforts in Congress to establish patient protections around insurance-mandated step therapy protocols in employer-sponsored plans. The “Safe Step Act” (H.R. 2279/S. 2546), as introduced by Rep. Ruiz (D-CA) in the House and Sen. Lisa Murkowski (R-AK) in the Senate, would provide protections that would help patients access the right medication at the right time, and avoid unnecessary and potentially expensive adverse health outcomes that could result from delayed or ineffective treatment. This legislation would require health insurers to provide an exceptions process for any medication step therapy protocol based on clinical decision-making, medical necessity, and other patient needs.

Moderating Drug Costs Through Negotiation: Congress should reduce prescription drug costs by passing the Medicare Prescription Drug Price Negotiation Act of 2019 (H.R. 275/S. 62), which would help to reduce drug prices by allowing the federal government to negotiate lower drug prices on behalf of Medicare beneficiaries.

Providing Needed Transparency in Prescription Drug Pricing: Congress should address transparency in prescription drug pricing by passing the Prescription Drug STAR Act (H.R. 2113), which would require manufacturers to justify and explain price spikes on their drugs as well as reveal the price and quantity of the drug free samples that they give to clinicians.
